Privacy policy

FIRST — Personal data

For the purposes of this notice, “personal data” means any information through which a natural or legal person can be identified, such as name, address, age, etc. Any information that cannot be classified as personal data will be referred to as “non-personal data” for the purposes of this notice.

SECOND — Collection and use of personal data

The client agrees to share with APEX the personal data consisting of their name, email address, phone number and any other data disclosed by filling out forms or communicating directly with APEX. This data is used to prepare a personalized quote or a contract, and to communicate with the client.

Likewise, your personal data may be used for the following purposes which, while not required to provide the service, allow us to give you better attention:

• Sharing promotions or new products that match the client's profile.
• Sharing APEX news that may be of interest to the client.
• Transportation, loading, unloading, delivery, installation or maintenance of the products purchased.
• Maintaining effective communication with the client to provide the best possible service.

THIRD — Opting out

If the client does not consent to the use of their data for any of the purposes set out in section SECOND of this notice, they may state so at the time of the quote, specifying it in the “PROJECT DESCRIPTION” field of the quote form available at https://www.apex.mx/en/quote. Likewise, if at any other time the client decides to limit the use of their personal data, they may notify APEX by email at contacto@apex.mx or by calling +52 444 585 3356.

FOURTH — Collection and use of non-personal data

When browsing https://www.apex.mx (the “website”), the client shares with APEX data such as their IP address, language, actions on the website and referring page. Data collected this way is used for the following purposes:

• Optimizing the browsing experience — including, without limitation, form autofill, adjusting the language in which the website is displayed, remembering user preferences, deriving browsing preferences, client behavior and digital preferences, etc.

FIFTH — Disclosure to third parties

Under no circumstances will APEX disclose its users' personal data to third parties except by court order or ruling, administrative act, or because the very nature of the services provided or products sold requires it. APEX will give timely notice whenever it is necessary to share your personal data with the aforementioned third parties.

SIXTH — ARCO rights

Clients may at any time submit any of the following requests to APEX:

• To know the personal data APEX holds about them, how it is being used and the conditions under which it is stored.
• To correct personal data that is inaccurate, erroneous, outdated or incomplete.
• To be removed from APEX's records or databases when the client considers that storing their data is no longer necessary.
• To object to the use of their personal data for specific purposes.

Requests can be made at any time by email to contacto@apex.mx and, except as provided in section THIRD above, APEX may not refuse to comply with them.

SEVENTH — Cookies

APEX websites use cookies to collect non-personal data. APEX may inform the client of this upon entering the home page, giving the option to disable this feature or continue. If the client wishes, they can disable this feature at any time by changing their browser settings:

• In Google Chrome: go to Settings, “Privacy and Security”, “Cookies and other site data”, “Sites that can never use cookies”, select “Add”, type “https://www.apex.mx/” in the text box, select “All cookies, on this site only” and finally select “Add”.
• In Mozilla Firefox: go to Tools, “Options”, “Privacy”, set “Firefox will:” to “Use custom settings for history”, select “disable cookies” and finally select “OK”.

EIGHTH — Updates and availability

This notice, in its most recently updated version, is available for consultation at https://www.apex.mx/politica-de-privacidad/. Changes and updates will be published on the APEX website home page (https://www.apex.mx/) and sent to the email address of interested clients. In case of any discrepancy, the Spanish version of this notice prevails.

NINTH — APEX mobile app

Our mobile application, restricted to APEX-authorized staff and clients, may request access to the following features of your device, solely to operate the service:

• Camera and photo gallery: to attach photographic evidence and the confirmation video of the service performed on site.
• Microphone: to record the client's confirmation video when signing the service order.
• Location (GPS): to validate that the service was performed at the client's site at the time of signing.

This data is associated exclusively with the corresponding service order and is not shared with third parties for advertising purposes. Access to the application is restricted to users with credentials granted by APEX; accounts are created and managed by APEX (there is no open sign-up). To request deletion of an account or of your data, write to contacto@apex.mx.
